2. RETURN POLICY

You have 30 days to request a refund after you receive your order. Refunds are not given for sample bottles. Please contact Customer Care to initiate the return process. There shall be no right or authority for any claim to be arbitrated on a class action basis or in a purported representative capacity. No claim submitted to arbitration is heard by a jury or may be brought as a private attorney general. You do not have the right to act as a class representative or participate as a member of a class of claimants with respect to any claim submitted to arbitration. The arbitrator may not consolidate more than one person's claims against VITAL RISE GUMMIES and may not preside over any kind of representative or class proceeding against VITAL RISE GUMMIES. You acknowledge that this class action waiver is material and essential to the arbitration of any disputes between the parties and is nonseverable from the agreement to arbitrate claims. Notice shall be deemed given twenty four (24) hours after email is sent, unless VITAL RISE GUMMIES is notified that the email address is invalid. In such case, notice shall be deemed given three (3) days after the date of mailing.

13.5 ASSIGNMENT

VITAL RISE GUMMIES's failure to act with respect to a breach by You or others does not waive our right to act with respect to subsequent or similar breaches.

13.9 SURVIVAL
